1. General

This is the hihosilver.co.uk website ("Website") which is owned by House and Wine ltd trading as Hiho who are a company registered in England (company number 05627807) with a registered office at Rosy Jeffery Accountants, The Loft, Unit 11, Hunthay Business Park, Axminster, EX13 5RJ. ("we", "us"). By purchasing any products (the "Product") and by using this Website you acknowledge that you have read and you agree to be bound by and comply with these Terms and Conditions. Your statutory rights are not affected.

2. Purchase of Products

The placing of a Product on our Website is an invitation to accept offers for such Product and is not an offer to sell at the listed price nor is it binding on us. We are under no obligation to accept your order (whether or not the order has been confirmed and the credit card been charged).
We will acknowledge by e-mail your order for a Product at the time you place your order. We will then notify you within 2 days of such email whether we have accepted your order. At the same time if we have accepted your order we will notify you of delivery dates.
In the event a Product is listed at an incorrect price due to a typographical error, we will notify you of the correct price by e-mail and we will give you the choice of either purchasing the Product at the correct price or cancelling your order. If you confirm you want the Product at the corrected price we will deliver the Product to you. If payment has been charged for the purchase and you cancel your order we will, on return of the Product (if the Product has been sent out) immediately issue a refund.
Any order (whether or not accepted) is subject to availability of the Product. If the Product becomes unavailable prior to delivery we will notify you and give you the choice of a refund or of purchasing an alternative Product.

3. Cancellation of contract by you

You may cancel the contract at any time up to and including the fourteenth working day after the day on which the goods are delivered to you by notifying us by email or post at the addresses set out at the beginning of these Terms and Conditions.
If you cancel the contract you must return the goods to us at the address set out at the beginning of these Terms and Conditions at your own cost and risk. If you cancel the contract and then you receive the goods you must not unpack them from their packaging but must immediately send them back to us.
In any event, you must return the goods to us within 17 days of receiving them.
If you do not return the goods to us within 17 days we will contact you. If we have to collect them from you we will deduct any costs we incur in recovering the goods from your payment to us prior to re-crediting your charge card.
Provided that we receive the goods in the condition they were in when delivered to you then we will re-credit your charge card with the amount debited for your order for the goods in question as soon as possible and, in any event, within 30 days of your cancelling the contract.
Until you return the goods to us you must keep them in your possession and take reasonable care of them.

4. Defective Goods

If the Products delivered are defective, not what you ordered, or damaged on delivery please notify us straight away and return them to us using Recorded Delivery. You should keep a proof of posting. Full postal costs will be refunded.
We will repair, replace or refund you for the price paid for any Products which are found to be incorrect or damaged on delivery for a period of 3 months after delivery.
If you opt to exchange the Products, any additional payments must be included with the returned Products. Replacement Products will not be dispatched until such payment has been received.
Risk in the Products passes to you when the Products are signed for at the delivery address stipulated in your order. We accept no responsibility for any damage or loss to the Products after risk passes.

5. Prices and Payment

The prices for the Products and delivery are as set out on the Website.
Payments must be made by credit or debit card and we shall not dispatch any Products until we receive confirmation of payment.
Your payment will be processed by a secure connection at the time you place your order on the relevant section of the Website.
We will inform you as soon as we can if we are unable to deliver the Products within 30 days of your order and you may agree an alternative delivery period or you may cancel the order. In no event shall we be liable to you for any losses you may have for any delay in delivery.

6. User Content

You are solely responsible for the photos, text, materials and other content that you upload (hereinafter, "post") on the Website (collectively "User Content"). You may not post User Content on the Website that you did not create or that you do not have permission to post. You are prohibited from posting to the Website any User Content that is offensive, illegal, pornographic, discriminatory or which is technically harmful or infringes or may infringe the rights of any third party.
You understand and agree that we may, but are not obligated to, review the Website and may delete or remove (without notice) any User Content in our sole discretion, for any reason or no reason, or that in our sole judgement may be offensive, illegal or technically harmful or that infringes or may infringe the rights of any third party.
You agree that we may copy, disclose, distribute, or otherwise use any User Content posted on the Website for any purpose. You may request that we remove your User Content at any time by contacting us via the Contact Details at clause 16.
You agree to indemnify and keep us indemnified from and against any losses, costs, expenses and damages incurred by us in respect of any claim that the User Content infringes the copyright and/or intellectual property rights of a third party.

7. Limitation of our liability

Whilst we have taken all reasonable steps to ensure the accuracy and completeness of the information on this Website it is provided on an "as is" basis and we give no warranty and make no representation regarding the accuracy or completeness of the content of this Website. Further more, no warranty is given that the Website shall be available on an uninterrupted basis, and no liability can be accepted in respect of losses or damages arising out of such unavailability.
Access to and use of this Website is at your own risk. We do not warrant that the use of this Website or any material downloaded from it will not cause damage to any property, including but not limited to loss of data or computer virus infection. We accept no liability for viruses. We recommend that you take all appropriate safeguards before downloading information or images from the Website.
In respect of any cause of action (including an action for negligence) arising out of or in connection with any purchase made from the Website, our entire liability shall be limited, to the extent that the cause of action relates to the items purchased on our Website to (at your option):
1. repairing or supplying the Products again; and
2. refunding the amount paid by you in respect of the Products purchased.
Our aggregate liability in respect of all causes of action arising out of or in connection with the Products purchased on our Website or in connection with your use of the Website (whether for breach of contract, in negligence or any other tort, under statute or otherwise at all) will not exceed an amount equal to the value of the Products delivered to you under these Terms and Conditions.
We shall not be liable to you for any loss of profit; loss of anticipated revenue (whether direct or indirect loss); or any consequential or indirect loss.
Notwithstanding anything in these Terms and Conditions we do not exclude liability for:
1. personal injury and death caused by our negligence;
2. fraud; or
3. any liability under the Consumer Protection Act 1987.
Except for any warranties expressly set out in these Terms and Conditions any warranties, conditions or representations whether implied by statute or otherwise shall be excluded to the fullest extent permitted by law.

8. Security

Our secure server software encrypts all your payment card details. The process scrambles all the information, allowing no unauthorised third party to intercept the data. Your browser will confirm that you are shopping in a secure environment by showing either a locked padlock icon or an image of a padlock next to the payment details in the relevant area of the Website.

9. Complaints Procedure

Our aim will always be to deal with your complaint as soon as possible and make every effort to reach a satisfactory conclusion on your behalf in order to retain your valued custom.

Customer Service and the Quality of our products, are very important to us and we hope that you will always be satisfied with the service that we provide you, both online and in our stores. If for any reason you are unhappy with our products or the service that we provide you, then please do contact us, using the contact details above and we will help you to resolve the issue and either provide you with a new piece, a refund or an exchange.

10. Intellectual Property

All Website, design, text and graphics belong to us. All copyright, trade marks and other intellectual property belongs to us.
You are not permitted to use the Website in any way that may infringe the intellectual property rights contained in the Website. This means that you may not adapt, reproduce, publish, upload, extract, alter, store, post, redistribute, reutilise, retransmit or broadcast, all or any of the contents of the Website including but not limited to any trade marks or copyrighted material without our express permission. However, you are permitted to download and print out pages from the Website for the sole purpose of viewing for your own personal information.

11. Entire Agreement

These Terms and Conditions represent the entire understanding relating to the use of the Website and supersede all other statements, representations or warranties (whether written, made by email or oral) made by us. Nothing in these Terms and Conditions shall affect the liability of either party in respect of any misrepresentation, warranty or condition that it makes fraudulently. Any rights not expressly granted in these Terms and Conditions are reserved by us.

12. Severance

If any provision of these Terms and Conditions are found to be invalid or unenforceable by a court, it will be severed from the rest of these Terms and Conditions which shall remain unaffected.

13. Third Party Rights

A person who is not a party to this contract is not entitled to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

14. Force Majeure

We shall not be liable to you for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.

15. Law and Jurisdiction

These Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales. Disputes arising in relation to this Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Certain provisions contained in these Terms and Conditions may be disallowed by the laws of the country from which you are accessing the Website. If any provision is unenforceable or invalid then the provisions of paragraph 11 shall apply.

Competition T & C's

Please read these competition rules carefully. If you enter one of our competitions, we will assume that you have read these rules and that you agree to them.

Open to UK residents, 18 years or older. Not open to employees (or members of their immediate families) of Hiho Silver. The closing date is as specified on the promotion. No entries will be accepted after the closing date. If in writing, entries that are incomplete, illegible, indecipherable will not be valid and deemed void. If online, entries that are incomplete will not be valid and deemed void. All entries must be made directly by the person entering the competition. No responsibility can be accepted for entries lost, damaged, delayed in the post or due to computer error in transit. The prizes are as stated, are not transferable to another individual and no cash or other alternatives will be offered. If prizes are entry tickets to events, tickets are for private use only and are not for resale for commercial gain to the holder. If Hiho Silver has reason to believe that tickets are being resold we may invalidate them and refuse entry to the event.The winner(s) is (are) responsible for expenses and arrangements not specifically included in the prizes, including any necessary travel arrangements if applicable. You can unsubscribe at anytime.The winner(s) agree(s) to the use of their name, photograph if applicable and disclosure of county of residence and will co-operate with any other reasonable requests by Hiho Silver and their partners in the promotion relating to any post-winning publicity including Facebook and Twitter. Unless stated otherwise the winner(s) will be drawn at random from all correct entries received by the closing date stated within the promotional material. Reasonable efforts will be made to contact the winner(s). Failure to respond and/or provide an address for delivery, or failure to meet the eligibility requirements may result in forfeiture of the prize. The judges’ decision will be final, and no correspondence will be entered into. Generic Terms and Conditions

By entering any Hiho Silver competition (competition, promotion, giveaway, prize draw, offer or discount) entrants confirm that they have read and agreed to these terms and conditions and by the decisions of Hiho Silver (The Promoter), which are final in all matters relating to the prize. Failure to do so will result in the forfeiture of the prize. No correspondence will be entered into. Hiho Silver is operated by House and Wine Ltd trading as Hiho, PO Box 124, Chard, TA20 9BT.
'Competition' means any competition or promotion on one or more of our websites or social media sites. 'Entrant' means any person who enters the Competition.
Entrants must be residents of England, Scotland, Wales or Ireland, aged 18 and over.

Entry instructions: Please see the individual competition for the entry details. Alternatively, you can enter by sending a postcard with your full name, contact details (email and telephone number), name of the competition you are taking part in and response to the qualifying question. The postal entry must be received by 12pm of the published end date of the competition.
Only one entry per person per competition unless otherwise stated. All additional entries will be disqualified.
Any entries that the Promoter considers (in our absolute discretion) to be fraudulent, offensive, indecent, illegal, racist, copied, cruel or infringe on the rights or copyright of others will be immediately disqualified.
No third party or bulk entries. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, multiple email accounts, multiple reproduced or computer-generated entries, using multiple identities, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the Promoter or otherwise acting in violation of these terms, these participants will be disqualified, and any prize entitlement will be void.
Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery or receipt. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed, wrongly delivered, or not received for whatsoever reason.
Winner Selection: Prize draw winner (s) will be randomly selected by a computerised random generator from all correct entries. Skills based entries shall be judged based on the judging criteria, set out in the promotion.
Winner Notification: The winners will be notified by email provided when entering the competition. They will have 14 days from notification to claim their prize. If a winner does not claim their prize within this timeframe the promoter reserves the right to withdraw prize entitlement and will award the prize to a reserve drawn at the same time as the original.
It is the responsibility of the entrant to provide correct, up-to-date details when entering the competition and acceptance of the prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
General: Promoter’s decision is final and binding. No correspondence will be entered into. Entry implies acceptance of these terms and conditions.
Prizes must be accepted as offered by the named winner. There is no cash or alternative prizes, in whole or part. The prizes are not transferable and cannot be resold.

The Promoter reserves the right to verify winners and ask for proof of identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.
You agree that if you are a winner, you will take part in and co-operate fully with reasonable publicity and to the use of your name, photograph and any comments in such publicity without any fee being payable.
By entering the competition, each entrant grants the Promoter a world-wide, perpetual, irrevocable, non-exclusive, transferable, royalty free and sub-licensable right and licence to use reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property contained in the content of their entry, without royalty, payment or other compensation. Each Entrant agrees not to assert any moral rights in relation to such use and warrants that they have full authority to grant such rights.

The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.
Entry into the competition is at the entrant’s sole risk. To the extent permitted by law, neither the Promoter nor Supplier accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter and Supplier further disclaim liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these terms and conditions shall act to limit or exclude the Promoter and Supplier’s liability resulting from its negligence or fraud.
If for any reason, the competition is not capable of running as planned for reasons (including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
If an act, omission, event or circumstance occurs which are beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or prizes. The Promoter, the Supplier or its agencies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies.
Where a prize is provided by a Supplier, the Promoter accepts no responsibility for inaccuracy of any prize description, and The Supplier is responsible for prize fulfilment.
If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
The Promoter and the Supplier reserve the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment.
The decisions of the Promoter are final and binding in all matters relating to the Promotion and no correspondence will be entered into.
The Promotion and these terms and conditions, and any disputes arising therefrom, shall be subject to English law and the exclusive jurisdiction of the English and Welsh Courts.
Data Protection: Any personal information that entrants share with the Promoter will be kept secure and only used in line with these terms and conditions unless the entrant has opted in to future marketing from the Promoter and/or the Supplier. By entering the promotion, entrants agree that their information may be used by the Promoter to administer the promotion and winners consent to give their name and county for the winners’ list.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

Secure Shopping

Shopping online with Hiho Silver using your debit or credit card is safe and secure. In fact, contrary to popular belief, it's more secure than using your card in a shop or restaurant.Before the card number leaves your PC, it is encrypted using military-strength encryption, then transferred to our secure server software and passed directly to a bank for processing via a secure shopping gateway. The card number is never available to any human being at any stage in the process. The relevant bank or institution will then verify and authorise your card automatically, and if successful, pass an authorisation code back to us to confirm the transaction.We never see your complete credit card details and they are not stored by Hiho Silver. This does mean that next time you shop with us, you will have to input your card number again, which we know might be a little inconvenient. But we hope you'll agree that it's a small price to pay for complete security and total peace of mind.

Purple Points Terms and Conditions

The current conversion value of loyalty points is £1 spent will give you one Purple point equalling to £0.025 reward. We will not exchange Hiho purple points for cash. We may from time to time change the number of points you collect on products. We will display a notice on this page advising members of changes.

Hiho Purple points can be earned exclusively for purchases made online at www.hihosilver.co.uk. Excludes Sales, Charity items and gift vouchers. Cannot be claimed on purchases made at shows or via telephone orders.

To be awarded points, members must spend £1 or above on qualifying products in a single transaction, excluding taxes. During time of point promotions or special offers, the amount of points awarded may change and may vary depending on the products bought or the amount spent.

Hiho is entitled to remove points at any time if products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products with an equivalent points value.

Earned points can be viewed in the customer account section. They have no value until converted into vouchers. Points are valid for 365 days from issue date after which they will expire.

As soon as a £5 value minimum of Purple Points is collected from the purchases, the points can be converted into a loyalty voucher at any time.

Once converted into a loyalty voucher, the voucher can be redeemed exclusively on online purchases using the redemption code provided and until the validity date given, which is one month after the conversion. Once a voucher has been converted, this process cannot be undone. Vouchers cannot be redeemed against Charity, Last Chance / Sale items and gift vouchers.

Each Hiho loyalty voucher must be used in full in one transaction and no change will be given. The coupon can be used as part payment towards product(s) of a higher value provided the balance of the payment is covered by another suitable method.

Points awarded at the time of a transaction or vouchers already issued may be removed or cancelled if Hiho determines that the points were collected in breach of these terms and conditions or were awarded in error. For the avoidance of doubt, no advice given or action taken by our staff that is contrary to these terms and conditions will have the effect of changing these terms and conditions.
